At its meeting on February 6, 2023, the Gaithersburg City Council approved Shulman Roger’s client One Central LLC’s request to rezone an assemblage of six parcels from the Low-Density Residential Zone to the Corridor Development Zone to allow the development of 72 two-over-two stacked townhomes. Shulman Rogers land use attorney Todd Brown guided the development team through the review process and secured rezoning and schematic development plan approvals for the property earlier this week. The City Council vote was unanimous, as was the City Planning Commission’s recommendation.
The property is located near the southeast quadrant of the intersection of East Deer Park Drive and South Frederick Avenue and is trisected by three stream channels, stream buffers and floodplains. The development review process consequently presented a number of unique challenges.
As land use attorney, Todd guided the development team in securing not only the rezoning and schematic development plan approvals but also waivers of environmental standards to allow stream valley disturbance, road code standards to allow for modified street sections, maximum building height standards, a variance for removal of mature trees, and a waiver of parking standards.
