Shulman Rogers Assists Municipalities In Re-Writing Tower Ordinances
Many municipalities across the country are being inundated with applications from small cell providers who are looking to build Distributed Antenna Systems (DAS) systems throughout the area on utility poles when available, and new poles when there are no existing options. The FCC is fully supportive of these efforts to bring so-called 5th Generation (5G) wireless technology to the country.
These same municipalities are often finding that their ordinances are not compliant with current federal law (which was updated over the past year), and/or are inadequate to deal with the myriad of issues which these construction projects bring. Striking the proper balance between the consumer desire for coverage, the federally imposed obligation to meet established time frames for response (the “shot clock”) and the consumer desire to avoid what they believe are community eyesores can be challenging.
