Confidential Settlement Obtained for Survivor of Brandeis University Bus Tragedy
Shulman Rogers is pleased to announce a confidential settlement obtained on behalf of our client, a 21-year-old student at Brandeis University in Massachusetts. On November 19, 2022, a bus transporting students around the campus of Brandeis University went airborne, struck two trees, and smashed head-on into a third tree before coming to a stop. Despite carrying over 20 passengers on the bus, the driver drove recklessly, speeding 54 mph in a 30 mph zone, and lost control of the bus. This was a completely preventable and unnecessary tragedy.
Our client was standing at the front of the bus and witnessed the speed and erratic driving firsthand. She suffered significant pre-impact fright as her location gave her a clear, traumatic view of the moments before, during, and after the bus flew into the air off the roadway. Her shoes came off as a result of the force and violence of the successive impacts. After the collision, amid a scene of chaos and debris, she was trapped for at least 10 minutes. During this time, she was in shock and in severe pain, and covered in her own blood and the blood of her classmates. She lay helpless as she heard her classmates screaming in pain. Tragically, a student died, another was permanently maimed, and many suffered grisly, serious injuries.
Our client suffered multiple severe injuries, including but not limited to a large forehead laceration, numerous other cuts, a closed head injury, neck, heel, and back injuries, significant emotional distress, and PTSD. At the hospital, shards of glass were removed from her foot. The large forehead laceration will require future scar revision surgery.
This was a complicated legal case involving 21 injured parties, several defendants, and multiple insurance companies, with competing interests. The case spanned over three years and required two separate mediations to resolve. An extremely favorable confidential settlement was reached for our client, who can now put this chapter behind her and heal.
