Employment Roundtable: The ABC's of Employee Discipline and Termination

The ABC's of Employee Discipline and Termination
October 28, 2010

The EEOC and local agencies have all confirmed a significant rise in employment-related claims (“Charges”), a reflection of tough economic times and unemployment far in excess of anything we have experienced in a very long time.  Increased employment terminations coupled with the continuing, limited prospects for re-employment have created the “perfect storm” – and a potential legal minefield for employers.  Now, more than ever, employee discipline up to and including termination is being scrutinized and aggressively challenged.  Consequently, businesses must review and, when warranted, revise both their policies and practices regarding employee discipline and termination.  The substantial cost (economic and opportunity) of defending against these Charges, makes this Roundtable a “must attend” event for any business owner, manager or HR Director tasked with navigating these increasingly rough waters…

Please join us on October 28, 2010, as our employment attorneys take on this important topic.  This discussion will focus on:

o   the “benefits” of having an employee discipline policy;

o   developing a discipline policy that makes sense for your company;

o   the keys to implementing and applying any discipline policy; and

o   avoiding common mistakes in discipline policies and in their application.

To assist you when you determine that a termination is warranted, our discussion will also highlight:

o   what steps or pre-termination analysis a company/manager should consider;

o   suggested methods for effectuating terminations; and finally

o   common mistakes businesses can make that may invite a post-termination claim or create potential liability.
