
Mr. Talcott is Chair of the Foreclosure Practice Group and has extensive experience in all aspects of bankruptcy law, creditors' rights and related matters. Mr. Talcott regularly represents various local and national financial institutions, insurance companies and other lenders in their commercial and residential loan activities as well as in workouts, foreclosures, possessory actions and related litigation. Mr. Talcott's bankruptcy practice includes motions and adversary proceedings in the context of lift stay, fraudulent transfer, validity and priority of claims, dischargeability, among others, at both the trial and appellate level. Among the noteworthy cases in which he participated is White v. Simard, 152 Md. App. 229, 831 A.2d 517 (2003), aff'd, 383 Md. 257, 859 A.2d 168 (2004) which established an exception to 100 year old common law rule regarding application of surplus proceeds obtained at a resale. After the litigation was successfully completed, the state passed a law which incorporated the holding of the case.
Mr. Talcott has been asked to testify as an expert witness regarding local foreclosure and major collection procedures and he has been appointed trustee by the court to conduct sales in connection with partition proceedings.
Mr. Talcott attended the U. S. Coast Guard Academy, obtained his degree from the University of Maryland in 1973 and obtained his juris doctor degree from The American University, Washington College of Law, in 1978. He is a member of numerous national, state and local bar committees, and The Barristers. Mr. Talcott has been a member of the Board of Directors of EagleBank, a bank organized under the laws of the State of Maryland, to serve the business community of Montgomery County, Northern Virginia, the District of Columbia and the Washington, DC metropolitan area. He is an active supporter of the Juvenile Diabetes Research Foundation International and is a past-president of the Capitol Chapter.
