
Stacey L. Schwaber is an associate in the Firm's Employment & Labor Practice Group. Her practice focuses both on advising employers on policies, practices and preventative measures to avoid litigation, and also representing employers in litigation when necessary. Ms. Schwaber counsels employers concerning employee misconduct, workplace harassment, compensation and leave issues, and represents employers in litigation involving discrimination, sexual harassment, compensation, non-competition and non-solicitation covenants and breach of contract. She also reviews employee handbooks and conducts training programs for management and employees.
Ms.Schwaber represents employers before federal and state courts, at both the trial and appellate level, and before administrative agencies including the Equal Employment Opportunity Commission and state and municipal human rights commissions. She also represents employers in dealings with labor unions, including collective bargaining negotiations, and in unfair labor practice and union representation proceedings before the National Labor Relations Board.
In an example of a recent trial success, Ms. Schwaber defended an employer against allegations of a sexually and racially hostile environment brought by the EEOC. The EEOC claimed that, among other things, a former employee and others were continually exposed to pornography at work, racial slurs and sexually offensive language, and that the employer did not take reasonable actions in response to the employee’s complaints. After a 7 day trial, the jury disagreed.
Prior to joining the Firm, Ms. Schwaber clerked for the Office of the General Counsel of the United States Peace Corps with a focus on equal employment opportunity litigation.
