On behalf of a large electronics corporation, Eric von Vorys filed an opposition at the Trademark Trial and Appeal Board against a competitor's federal trademark application. The competitor's trademark was almost identical in appearance, sound and meaning and was promoting competing services. After limited discovery, Eric von Vorys filed a motion for summary judgment arguing that there were no facts in dispute and that it was clear that the respective marks were confusingly similar. The motion was granted and the competitor's trademark application was refused registration.
