Mr. Grant is the co-chair of Shulman Rogers' Business Litigation Group and brings extensive experience to the Firm and its clients from eighteen years of representing corporations, partnerships, limited liability entities and sole proprietorships in all forms of business-related disputes whether in Maryland, Virginia, the District of Columbia or in the numerous other jurisdictions across the country where his clients regularly transact business.
Mr. Grant's primary focus is on the protection of his client's proprietary interests, competitive advantages and legal rights both in their commercial business dealings and, more often, in dealing with their own employees, officers and directors or the independent contractors, brokers, and joint venture partners they may affiliate with. He espouses a pragmatic, cost-benefit approach in the resolution of all business and employment related concerns through client counseling, negotiation, litigation or ADR. Emphasizing that "dispute avoidance" is just as, if not more valuable to his clients than his zealous advocacy, he encourages clients to review and when warranted, revise not just their existing business contracts but their internal policies, controls and supporting agreements on a regular basis.
As a member of Shulman Rogers' Employment Group, Mr. Grant works extensively in Virginia, Maryland and the District of Columbia on matters involving employee-employer, shareholder, partner, fiduciary and officer/director obligations and/or disuptes in commercial business operations. As a result, he is regularly engaged to secure Temporary Restraining Orders (TRO's) and Preliminary Injunctions when prosecuting trade secret and/or restrictive covenant (non-compete) violations in federal or state courts. Recognizing the benefit of his "plaintiff" experience and insight, Mr. Grant is also asked to defend exiting employees or their new employers from overbroad contract restrictions and other unfair restraints on trade. As part of this practice, Mr. Grant has defended, and continues to counsel and represent, investment brokers "in transition", whether they are joining a current member of the Protocol for Broker Recruitment, pursuing Protocol membership for their chosen entity or should they choose to pursue an independent path with the likelihood of litigation or arbitration.
Outside of the courtroom, Mr. Grant routinely represents clients in response to EEOC or locally-initiated investigations of employee or former-employee claims of discrimination, retaliation or other statutory violations. He provides counsel and support to clients regarding employee discipline issues and assists in properly identifying, analyzing and working through the myriad of challenges faced by office managers, HR Directors, Presidents, CEO's or small business owners every day they open for business.
In addition to representing an array of "for-profit" commercial entities, Mr. Grant serves as "outside in-house counsel" to several 501 (c)(3) not-for-profit associations and federations. While offering much of the same support and counsel as provided to commercial entities, Mr. Grant also guides these clients in matters involving anti-trust compliance and training, membership (exclusion and expulsion) issues, standards setting and certification. Further, as a member of the Government Contracts Group, Mr. Grant also counsels government contractors in federal compliance matters including administrative, civil and debarment proceedings resulting from Inspector General or Department of Justice investigations and prosecutions.
Mr. Grant obtained his juris doctor degree from Georgetown University Law Center in 1990. Prior to that, he served as assistant to the Executive Vice President and Provost of Georgetown University, where he gained extensive experience in academic administration and fund-raising, all while managing to spend summers "in residence" at Georgetown's Villa le Balze in Fiesole, Italy. Mr. Grant graduated from Georgetown University's Edmund A. Walsh School of Foreign Service in 1985 with a bachelor of science degree and concentration in international relations, law and diplomacy. He was born in Milwaukee, Wisconsin and currently lives in Northern Virginia.
